Terms of Service

Effective date: July 2, 2026

These Terms of Service ("Terms") govern use of FamilyCare Facility, operated by Smith App Studio ("we", "us"), at familycarefacility.com and app.familycarefacility.com. By creating an account or using the service, you and the organization you represent agree to these Terms.

The Service

FamilyCare Facility is an operations and documentation platform for senior centers and residential group homes: member and resident records, attendance and check-in, activities, meals, incident documentation, scheduling, reporting (including OAA grant reporting), documents, and family communication. It is not an electronic medical record, medication-administration, or insurance-billing system, and it does not perform clinical charting.

Eligibility & Accounts

Acceptable Use

You may not misuse the platform — including attempting to access another facility's data, probing or disrupting the service, reverse engineering it, uploading unlawful content, impersonating others, or using the service to violate the privacy rights of residents, members, or families.

Subscriptions & Billing

PHI & HIPAA Disclaimer

FamilyCare Facility is not a covered entity's BAA-backed system unless separately agreed in writing. We do not sign Business Associate Agreements as part of standard plans, and clinical/PHI features remain locked pending our formal HIPAA compliance work. Your organization is solely responsible for determining whether its use of the platform involves Protected Health Information and for complying with HIPAA and any other laws that apply to it. Do not enter PHI unless a separate written agreement with us covers it.

Your Data

Your organization owns the data it enters. You can export your records at any time. We use your data only to provide and secure the service, as described in our Privacy Policy — we never sell it.

Intellectual Property

The platform, its software, and its content (excluding your data) are owned by Smith App Studio and protected by copyright, trademark, and other intellectual property laws. We grant your organization a limited, non-exclusive, non-transferable right to use the service during your subscription. White-label branding does not transfer any ownership of the underlying platform.

Termination

You may stop using the service and cancel at any time. We may suspend or terminate access for material breach of these Terms, non-payment, or unlawful use — with notice and a chance to cure where practical. After termination, we provide a reasonable window to export your data before deletion, as described in the Privacy Policy.

Disclaimers & Limitation of Liability

The service is provided "as is" and "as available." We do not warrant that it will be uninterrupted or error-free, and no software can guarantee an inspection, audit, or funding outcome. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the fees your organization paid us in the 12 months before the claim.

Governing Law

These Terms are governed by the laws of the United States and the state of our business registration, without regard to conflict-of-law rules.

Changes to These Terms

We may update these Terms from time to time. We will post the updated version here with a new effective date, and for material changes we will notify facility administrators. Continued use after changes take effect constitutes acceptance.
